These Terms and Conditions (“Terms”) govern your use of this website and any purchases or pledges made through it. By using this site, placing an order, or backing a campaign, you agree to be bound by the following terms.

1. Company Info
This site is operated by Digital Tripwire LLC. Our product lines include Smashpodz™ (safety technology) and Cherry Smash™ (collectibles and entertainment).

2. Product Use & Limitations
Smashpodz™ is a passive Bluetooth-based safety device. It is not a GPS tracker and does not provide real-time location data. The system logs nearby digital identifiers and makes them available to law enforcement only when a device is escalated as missing.

Results are not guaranteed. Smashpodz™ is a tool to aid recovery — not a substitute for police or emergency services.

3. Orders, Pre-Orders & Kickstarter Pledges
Orders placed through Kickstarter or other crowdfunding platforms are pledges, not retail transactions. Delivery timelines are estimates only, and delays may occur due to production, supply chain issues, or other unforeseen factors.

Refunds and cancellations are not guaranteed and are evaluated case by case.

4. Returns & Refunds
We accept returns on unused, unopened items within 30 days of delivery.
We do not offer exchanges.

5. Shipping
We do our best to ship orders on time, but are not responsible for carrier delays, customs issues, or items marked as delivered but not received.
You are responsible for any international duties, taxes, or fees.

6. Intellectual Property
All content on this site, including characters, product designs, logos, and descriptions, is the intellectual property of Digital Tripwire LLC. Use without permission is prohibited.

7. Privacy

8. Limitation of Liability
To the fullest extent permitted by law, Digital Tripwire LLC is not liable for any indirect, incidental, punitive, or consequential damages arising from use of our products or website.

9. Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: natural disasters, government actions, wars, labor shortages, supply chain disruptions, pandemics, or power outages.

10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

11. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12. Entire Agreement
These Terms, along with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Digital Tripwire LLC regarding your use of the site and purchase of our products.
